Low Impact Collisions and Serious Injuries

One of the most common tactics used by insurance companies in Louisiana automobile accident cases is arguing that “minimal vehicle damage equals minimal injury.” Louisiana law does not support that assumption. Louisiana courts recognize that soft tissue injuries, spinal injuries, and concussions may exist even where photographs show limited damage.

Insurance companies frequently hire biomechanical experts to argue that the force of impact was insufficient to cause injury. These cases often require MRI findings, physician testimony, diagnostic studies, and detailed medical analysis. Delayed treatment, prior injuries, and social media activity are also commonly used by insurers to challenge claims.
