Law Changes the Prescriptive Period (Time Limitation) for Victims to File Suit

House Bill 492 was passed by the Louisiana Legislature and signed by Governor Edwards. La.R.S. 9:2800.9 will be revised and will go into effect on August 1, 2021. What Is Clergy Sexual Abuse of a Minor?

Clergy sexual abuse is the abuse of minor that is considered sexual in nature, and is committed by a member of the Catholic Church. The term ‘clergy’ in this context includes priests, monsignors, deacons, bishops, brothers, sisters (nuns), and staff.

Abuse of a child, specifically abuse that is sexual in nature, refers to the intentional harm of a minor and can be physical or psychological in nature. Since a minor cannot consent to ANY form of sexual activity, all acts of a sexual nature against a child are criminal. Forms of sexual abuse may include:

  • Exhibitionism, or exposing oneself to a minor

  • Fondling

  • Intercourse

  • Masturbation in the presence of a minor or forcing the minor to masturbate

  • Obscene phone calls, text messages, or digital interaction

  • Producing, owning, or sharing pornographic images or movies of children

  • Sex of any kind with a minor, including vaginal, oral, or anal

  • Sex trafficking

  • Any other sexual conduct that is harmful to a child’s mental, emotional, or physical welfare

The Devastating Effects of Sexual Abuse

Sexually assaulting anyone can cause lifelong devastation that negatively alters the victim’s well-being. Children and adults who have been sexually assaulted can suffer from significant sleeping disorders, ongoing depression, substance abuse, self-injury, and suicide, including suicidal ideation (thinking about suicide). The Archdiocese of New Orleans, six dioceses and their Bishops manage 474 churches and 185 Catholic schools across Louisiana. The Church provides services to hundreds of thousands of registered Catholics living in sixty-four parishes (counties).

While the Roman Catholic Church promotes itself as a safe community to enjoy worship and religious education, things are not always what they seem. In recent years, Church officials have had to reckon with their previous behavior of covering up evidence that predatory priests in their parishes were sexually abusing adults and underage minors.
